The Horse Drawn Carriage is a great option for persons over 100kg, but we do need to be notified in advance to ensure there is space on our carriage. All riders are required to wear a helmet. PAYMENT & PAYMENT TERMS * The price as specified in the Quotation (the Price), is due and payable in full upon acceptance of the quotation. Failing such payment and return of the signed quotation, which will be deemed to be acceptance of the conditions, the booking will be taken to be provisional and is subject to cancellation by the Company at any time and the client will have no right of recourse against the company. In the event of cancellation, this payment may be deferred to a future booking at the discretion of Wine Valley Horse Trails. PAYMENT TERMS & CONDITIONS * A 100% deposit or upfront credit card payment will confirm all bookings. No booking can be confirmed without the required proof of payment or credit card authorization. We accept all legal tender for payments. Payments can be made online when making a reservation. Telephonic reservations will require the completion of a credit card authorization form to secure booking. A 10% non-refundable admin fee will be charged for every booking canceled less than 30 days before your trip. If not extended and canceled, the 10% admin fee will be applicable. Our cancellation policy is as below: 1. No shows and cancellation within 7 days of departure – 100% not refundable cancellation fee. 2. A full refund will be considered on merit, by management, in the event of illness, hospitalization, accident or death, upon receipt of proof thereof. 3. A full refund will be granted should the activity be canceled in the interest of safety, prior to the trip by the operator. In case the client changes his / her itinerary at their own request, the company shall try to accommodate him / her, but may charge a cancellation or administration fee. This is subject to a new quotation, which will be given by the company to the client in writing via e-mail or text message. If client requests a service to be added to the program or a program to be amended/deviated he/she does it on own risk and at extra costs. GIFT VOUCHERS * A Gift Voucher is bought at the rate of your date of purchase. A Gift Voucher is valid for three years from the date purchased. A Gift Voucher is non-refundable. CONDUCT * The Client agrees that he/she will at all times comply with the Company’s or others’ requirements and instructions in regard to his/her conduct and he/she will not in any way constitute a hindrance to any other passenger or person on the tour, mode of conveyance, at any place of accommodation, The Client indemnifies and holds harmless the Company against damages suffered and/or costs incurred by the Company and/or any third party as a result of a breach of this clause. SPECIAL REQUESTS * Client, who has special requests, must specify such requests to the Company in writing. Whilst the Company will use its best endeavors to accommodate such requests, it does not guarantee that it will. AMENDMENTS * No amendment, cancellation or waiver of any term or right referred to herein shall be valid or binding unless reduced to writing and signed by both the Client and a duly authorized representative of the Company. Effect of termination. For this reason, we offer bay cruises, day braai trips, and fishing charters to the visitors to our popular town of LANGEBAAN and its surrounding areas. We have several years of chartering experience; our boats and skippers have been recognized by SAMSA (South African Maritime Safety Authority) and have the necessary Commercial Endorsements. CANCELLATION OF ACTIVITY VISIT SOUTH AFRICA operates in diverse and changeable weather conditions and all tours and activities are subject to these conditions. Management reserves the right to cancel any tour/activity due to unforeseen circumstances including but not limited to, unavailability, insufficient passengers, and/or unfavorable weather conditions. Clients will be assisted in rescheduling affected bookings. If the booking cannot be rescheduled, the next booking price (see refunds) will be refunded within 15 working days. In case of a weather cancellation, weather conditions are judged exclusively by the Management of VISIT SOUTH AFRICA and guests must report for the tour/activity unless notified by VISIT SOUTH AFRICA. REFUNDS There will be no refunds in the event of a no-show by a guest on the tour/activity date. In the event of an amendment not received 3 days prior to the activity booked, the guest will still be responsible for the full cost for the total number of passengers originally confirmed. • 30 days cancellation before arrival: 100% refund • 15 - 29 days cancellation before arrival: 75% refund • 8 - 14 days cancellation before arrival: 50% refund • 0 hrs - 7 days cancellation before arrival: 0% refund • If this tour/activity is bought as a Voucher or Gift Voucher then a 0% refund policy applies. RE-ROUTING OF ACTIVITY/TOURS In the unlikely event that VISIT SOUTH AFRICA does not have access to a specific area of the booked service or voucher on the day of the tour/activity then VISIT SOUTH AFRICA retains the right to re-route affected tours/activities accordingly. ARRIVAL AT VENUE Kindly ensure you arrive at the venue 30 minutes before your tour/activity departure time. Should you arrive later, your tour/activity may be forfeited and not refunded or rescheduled. If, however, you contact us before your tour commencement time, we may be able to make alternate arrangements. Timeously means well beforehand. LOSS OR DAMAGE OF ANY PROPERTY OF THE CLIENT The owners and managers of VISIT SOUTH AFRICA cannot be held liable or responsible for any loss or damage of any belongings or property of the clients. INDEMNITY All clients will be required to sign an indemnity before ANY tour/activity takes place. If a guest refuses to sign the indemnity form, the guest will not be able to partake in the tour/activity. The indemnity form must be signed by a Parent/Legal guardian for minors under 18 years. Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal guardian prior to the tour/activity. CHILD POLICY: Children Rates apply to minors aged between 4 and 11 years IN SOME OF THE TOURS/ACTIVITIES. Children are classified as a passenger, therefore, on certain tours/activities, the full rate will apply to them. Adult supervision is required for children 14 years old and younger. Some tours/activities do not allow children under 18 years old. COVID-19 AND ANY OTHER PANDEMIC DISCLAIMER VISIT SOUTH AFRICA cannot be held liable for any operational changes, cancellations or consequential damages incurred by you in the event that any activity/tour are not able to operate as planned, including any disruptions, cancellations or changes to planned schedules. You agree that it is your personal decision to take a tour/activity and that you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risk of COVID-19 / OTHER PANDEMIC, with you having taken full personal responsibility to inform yourself in relation thereto. VISIT SOUTH AFRICA does not assume any responsibility for and shall not be liable for any unsafe conditions or health hazards, including pandemics or other illnesses to which you may be exposed VISIT SOUTH AFRICA is not responsible for the acts or omissions of travel suppliers, including the failure by the travel suppliers to adhere to their own schedules, provide services or refunds or their failure to honor any future trip credit. Please note that most insurance policies have a specific clause stating that they do not cover epidemics and pandemics, especially when travel warnings are in place. It would be advisable for you to take advice from an insurance broker should you have any queries regarding the appropriateness of a travel insurance policy. VISIT SOUTH AFRICA shall not be liable for your election not to purchase insurance nor shall the Agency be liable to you for any denial of any claim by a travel insurer as it relates to COVID-19 / OTHER PANDEMIC or any other claim under the relevant policy. In case a tour/activity is rescheduled or postponed due to COVID-19 / OTHER PANDEMIC, VISIT SOUTH AFRICA will assist the client with rebooking at NO extra charge. If the client wishes to cancel his/her activity/tour – refer to our refund and cancellation policy. All refunds are subject to the cancellation policy of the relevant third-party service provider. In the event that the third-party service provider is able to provide a refund, you will be required to complete and submit a refund consent form, provided by us. We may charge a reasonable service fee of up to 15% for any cancellations and/or refunds processed. This will exclude third-party cancellation policy costs. We will endeavor to process all refunds within 15 working days. TOUR PRICES All tour prices are subject to change without prior notice.
