Should any traveller/delegate contravene the aforesaid prohibitions, Roof of Africa Tours (Pty) Ltd. will be entitled to immediately exclude the offender from the tour/conference/accommodation and such traveller/delegate will be responsible for his or her own repatriation and all costs associated therewith. Roof of Africa Tours (Pty) Ltd. will under no circumstance assist any such offender in any dealings or negotiations with any authority. Travellers/delegates shall be solely responsible for complying with the formalities required by police, customs, health and all other authorities at the point of departure, at the destination and whilst in transit. Whilst Roof of Africa Tours (Pty) Ltd. will endeavour to provide the client, prior to departure, with the latest information concerning such regulations and restrictions. Roof of Africa Tours (Pty) Ltd. shall not be responsible and does not accept any liability for any inaccuracies or omissions in this regard. Airlines Cancellation and refunds: • In the event of cancellation or failure for any reason whatsoever to use confirmed space, as ticketed, a minimum of 25% (twenty five percent) of the applicable airfare will be forfeited. A change of reservation will attract a penalty. Extension of ticket validity is not permitted, save when a passenger is hospitalized due to severe illness or in the event of death of a member of the passenger’s immediate family. Booking conditions and responsibilities: • All airfare reservations are arranged subject to the conditions imposed by the respective airline • It is the responsibility of the client to ensure that the traveller/delegate has at the very least one ‘empty’ page in their passport. Should this be ignored, the traveller/delegate will be sent back to their country of origin upon arrival at ORTIA, without permission to enter the country. It is strongly recommended that all clients take out comprehensive travel insurance including full medical cover, as well as cancellation and curtailment cover. Luggage must be clearly marked. One standard set of luggage, comprising one suitcase and one overnight bag per person is allowed. If in the opinion of Roof of Africa Tours (Pty) Ltd. the fulfilment of any tour, incentive or conference, or accommodation is considered impossible, illegal, or if in Roof of Africa Tours (Pty) Ltd. opinion inadvisable because of weather conditions, avalanches, volcanic activity, strikes, war, government interference and/or any other cause not arising from Roof of Africa Tours (Pty) Ltd. negligence, Roof of Africa Tours (Pty) Ltd. may at any time cancel such a tour, incentive or conference, or accommodation, or what remains of it or make alterations in the route, accommodation, price and/or any other aspect thereof as it thinks fit, and any losses and expenses resulting from such cancellation or alteration shall be borne by the client. In accordance with South African law and International practice, smoking is prohibited on vehicles at all times. The tourist guide or the driver will ensure that sufficient comfort stops are made to enable travellers to smoke outside. Roof of Africa Tours (Pty) Ltd. reserve the right to use smaller vehicles on its scheduled tours, day tours, overland tours or transfers should the number of passengers participating reduce sufficiently to warrant this. Accommodation is as specified in the tour itinerary, brochure or website. The use of specific accommodation is subject to availability. If the client makes a booking on behalf of any party, the client warrants to Roof of Africa Tours (Pty) Ltd. that the client is authorized by such traveller/delegate to make reservations on behalf of such traveller/delegate and is acting as such traveller’s/delegate’s agent and in so doing, binds such party to these conditions. Upon the reservation being accepted and confirmed by Roof of Africa Tours (Pty) Ltd., the client warrants that the traveller/delegate has been informed of and is bound by the terms and conditions set out herein. The client indemnifies and holds Roof of Africa Tours (Pty) Ltd. harmless against all claims for damage, loss and injury which any traveller/delegate may claim against Roof of Africa Tours (Pty) Ltd. if such claim is excluded in terms hereof. Provisional reservations held by Roof of Africa Tours (Pty) Ltd. on behalf of the client/traveller or delegate will be released if no confirmation in writing has been received by the client/traveller/delegate by the “confirm by date”, or if no deposit has been received. When requested by Roof of Africa Tours (Pty) Ltd., the client/traveller/delegate shall pay a deposit to Roof of Africa Tours (Pty) Ltd. to secure certain services. The standard deposit requirements as a percentage of the total booking value are as follows: * 13 months and over prior to travel 0% * 12 months prior to travel 15% * 3 months prior to travel 50% * 1 month prior to travel 100% Roof of Africa Tours (Pty) Ltd. reserves the right to change the standard deposit requirements, to be recorded in writing, on a separate contract between the client and Roof of Africa Tours (Pty) Ltd. and to be agreed upon and signed by both parties. The percentage deposit required of the total booking value will be determined according to the specific services required and the number of years, months or days prior to travel. All cancellations must be made in writing to Roof of Africa Tours (Pty) Ltd.. Roof of Africa Tours (Pty) Ltd. will reply back in writing to the client/traveller/delegate that the reservation has been cancelled. Should a reservation be cancelled by the client, traveller or delegate, cancellations fees will be due and payable as a percentage of the total booking value. Indemnity & Covid-19 Information • All guests are required to sign an indemnity and complete the Covid-19 questionnaire for all transfers and activities that they are participating in, prior to the departure. • A link will be sent via e-mail 24 hours prior to your activity/transfer date. • In the case of a guest refusing to sign the indemnity form or complete the Covid-19 questionnaire, the guest will not be able to partake in the activity/transfer and will not receive any refund. • The indemnity form must be signed by a Parent/Legal guardian for children under 18 years of age. • Any unaccompanied minor (a person under 18 years of age) requires the indemnity to be signed by a Parent/Legal guardian prior to the activity/transfer. • The required indemnity form can be signed online from your mobile phone to ensure that you have sufficient time to read and understand the conditions. • We are asking for more detailed information than usual. This information is to ensure we can address appropriately any risks, should you or one of our guests or staff become ill with suspected COVID-19, and to ensure that in such an event, the required contact tracing can be carried out. All information provided will only be shared with authorized persons. • NOTE: As per the regulations of the Disaster Management Act, 2002 published on 17 March 2020, any person who intentionally - 1. Misrepresents that he/she/any other person is infected with COVID-19 is guilty of an offense and on conviction can be fined and/or imprisoned (for up to 6 months). 2. At the well-placed bird hides along the edge of the lagoon a large variety of waders, sea birds, and flamingoes are usually present. Raptors, marsh, and dry region species also abound in the area. Of special note, is also the regular presence of Marsh Harriers and booted eagles, with Verreaux’s Black Eagles and African Fish eagles occasionally spotted. Of the many Dry Region species one is likely to spot the beautiful Bokmakierie, Cape White-eye, ostrich, and many more. The Park is also highly recommended for its beautiful flower display during the winter months, usually from June to mid-September and really is highly recommended. Many wildlife and antelope species such as Cape Mountain zebra, springbok, bontebok, duiker, steenbok, kudu, eland and even hartebeest are often seen at close range. This is a perfect long morning trip and can be suitably rounded off with a lunch at the restaurant in the Park or conveniently in Langebaan. CANCELLATION OF ACTIVITY VISIT SOUTH AFRICA operates in diverse and changeable weather conditions and all tours and activities are subject to these conditions. Management reserves the right to cancel any tour/activity due to unforeseen circumstances including but not limited to, unavailability, insufficient passengers and/or unfavourable weather conditions. Clients will be assisted in rescheduling affected bookings. If booking cannot be rescheduled, the nett booking price (see refunds) will be refunded within 15 working days. In case of a weather cancellation, weather conditions are judged exclusively by the Management of VISIT SOUTH AFRICA and guests must report for the tour/activity unless notified by VISIT SOUTH AFRICA. REFUNDS There will be no refunds in the event of a no-show by guest on the tour/activity date. In the event of an amendment not received 3 days prior to activity booked, the guest will still be responsible for the full cost for the total number of passengers originally confirmed. • 30 days cancellation before arrival: 100% refund • 15 - 29 days cancellation before arrival: 75% refund • 8 - 14 days cancellation before arrival: 50% refund • 0 hrs - 7 days cancellation before arrival: 0% refund • If this tour/activity is bought as a Voucher or Gift Voucher then a 0% refund policy applies. RE-ROUTING OF ACTIVITY/TOURS In the unlikely event that VISIT SOUTH AFRICA does not have access to specific area of the booked service or voucher on the day of the tour/activity then VISIT SOUTH AFRICA retains the right to re-route affected tours/activities accordingly. ARRIVAL AT VENUE Kindly ensure you arrive at the venue 30 minutes before your tour/activity departure time. Should you arrive later, your tour/activity may be forfeited and not refunded or rescheduled. If, however you contact us before your tour commencement time, we may be able to make alternate arrangements. Timeously means well beforehand. LOSS OR DAMAGE OF ANY PROPERTY OF THE CLIENT The owners and managers of VISIT SOUTH AFRICA cannot be held liable or responsible for any loss or damage of any belongings or property of the clients. INDEMNITY All clients will be required to sign an indemnity before ANY tour/activity takes place. CHILD POLICY: Children Rates apply to minors aged between 4 and 11 years IN SOME OF THE TOURS/ACTIVITIES. Children are classified as a passenger, therefore, on certain tours/activities, the full rate will apply to them. Adult supervision is required for children of 14 years old and younger. Some tours/activities do not allow children under 18 years old. COVID-19 AND ANY OTHER PANDEMIC DISCLAIMER VISIT SOUTH AFRICA cannot be held liable for any operational changes, cancellations or consequential damages incurred by you in the event that any activity/tour are not able to operate as planned, including any disruptions, cancellations or changes to planned schedules. You agree that it is your personal decision to take a tour/activity and that you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risk of COVID-19 / OTHER PANDEMIC, with you having taken full personal responsibility to inform yourself in relation thereto. VISIT SOUTH AFRICA does not assume any responsibility for and shall not be liable for any unsafe conditions or health hazards, including pandemics or other illnesses to which you may be exposed VISIT SOUTH AFRICA is not responsible for the acts or omissions of travel suppliers, including the failure by the travel suppliers to adhere to their own schedules, provide services or refunds or their failure to honour any future trip credit. Please note that most insurance policies have a specific clause stating that they do not cover epidemics and pandemics, especially when travel warnings are in place. It would be advisable for you to take advice from an insurance broker should you have any queries regarding the appropriateness of a travel insurance policy. VISIT SOUTH AFRICA shall not be liable for your election not to purchase insurance nor shall the Agency be liable to you for any denial of any claim by a travel insurer as it relates to COVID-19 / OTHER PANDEMIC or any other claim under the relevant policy. In case a tour/activity is rescheduled or postponed due to COVID-19 / OTHER PANDEMIC, VISIT SOUTH AFRICA will assist the client with rebooking at NO extra charge. If the client wishes to cancel his/her activity/tour – refer to our refund and cancellation policy. All refunds are subject to the cancellation policy of the relevant third-party service provider. In the event that the third-party service provider is able to provide a refund, you will be required to complete and submit a refund consent form, provided by us. We may charge a reasonable service fee of up to 15% for any cancellations and/or refunds processed. This will exclude third-party cancellation policy costs. We will endeavour to process all refunds within 15 working days. TOUR PRICES All tour prices are subject to change without prior notice. NOTE: minimum guests required to run certain tours/activities. Bank transfers or cash will only be accepted for direct bookings into the bank account of VISIT SOUTH AFRICA, the details of which will be provided on request. CREDIT CARD ACQUIRING AND SECURITY Credit card transactions will be acquired for PAYGENIUS who are the approved payment gateway. CUSTOMER DETAILS SEPARATE FROM CARD DETAILS Customer detail will be stored by VISIT SOUTH AFRICA separately from card details which are entered by the client on PayGenius’s security site. RESPONSIBILITY VISIT SOUTH AFRICA takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. COUNTRY OF DOMICILE This website is governed by the applicable laws of South Africa and VISIT SOUTH AFRICA chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice or other documents or communications of whatever nature.
