It is good exercise but you don’t have a high fitness level. The equipment and flies are available for hire, however you are welcome to bring your own if you prefer. The Private Clinic is for individuals or small groups between one to four people. We cover from novice to intermediate. Experienced guides will tailor-make the clinic and patiently teach you the skills required to match your skill level. We cover theory and practical fishing guidance. The teaching is done in a fun and easy-to-understand manner. We adhere to strict COVID protocols with sanitizing of hands, rental fishing equipment, and social distancing. It is outdoors in the open air. Younger children are welcome to attend a Private lesson, however we encourage one or more parents to participate. Guides are only available until 17h30. Fly fishing equipment supplied for the activity will only be available for the course of the event. Should guests like to use equipment after the activity is completed then they must complete a fishing permit/indemnity form and rent a rod as per the regular terms and conditions. Fly fishing is an outdoor event and we will still run events in windy, cold conditions. We also operate fly fishing in light rain which lends to the adventurous aspect. If cold weather or light rain is expected, then guests are recommended to bring raincoats or warm clothes. The events will only be canceled in the event of sustained bad weather or dangerous weather conditions. Bad weather = sustained heavy rain, snow or hail Dangerous weather = lightning or weather conditions that place guests in bodily danger. If an event is canceled due to bad or dangerous weather then the client has the option of a full refund or a credit that may be used within six months. PAYMENT TERMS & CONDITIONS * A 100% deposit or upfront credit card payment will confirm all bookings. No booking can be confirmed without the required proof of payment or credit card authorization. We accept all legal tender for payments. Payments can be made online when making a reservation. Telephonic reservations will require the completion of a credit card authorization form to secure booking. A 10% non-refundable admin fee will be charged for every booking canceled less than 30 days before your trip. In case of a natural disaster, flood, volcano, earthquake, hurricane, virus infection, or any other natural disaster, trips can be extended with no extra charge. If not extended and canceled, the 10% admin fee will be applicable. PRICE * Note that the company reserves the right to amend the price if an unreasonable time lapses between the date the Quotation is submitted to the client and the date it is returned to the company The onus will be on the client to check that there have been no changes in the price prior to making the full and final payment. However once payment of the price in full is received, price is guaranteed (subject to statutory increases such as VAT. Should it be a group booking and the group number deviates from the number required for the booking, the company reserves the right to re cost the Price and raise a surcharge or to reschedule. Should any Client refuse to accept and pay such surcharges, the Company reserves the right to cancel the booking and retain any payment made. Please note that given the sensitivity of the South African Currency, the Price is subject to foreign exchange volatility and subject to change from time to time. Please check before you book and pay. However, once paid in full the price will not change. Clients are not entitled to a refund should weather conditions suddenly change during or before embarking upon any activity. REFUND POLICY * We encourage advance bookings based on demand. Our cancellation policy is as below: 1. No shows and cancellation within 7 days of departure – 100% not refundable cancellation fee. 2. A full refund will be considered on merit, by management, in the event of illness, hospitalization, accident or death, upon receipt of proof thereof. 3. A full refund will be granted should the activity be canceled in the interest of safety, prior to the trip by the operator. In case the client changes his / her itinerary at their own request, the company shall try to accommodate him / her, but may charge a cancellation or administration fee. This is subject to a new quotation, which will be given by the company to the client in writing via e-mail or text message. If client requests a service to be added to the program or a program to be amended/deviated he/she does it on own risk and at extra costs. GIFT VOUCHERS * A Gift Voucher is bought at the rate of your date of purchase. A Gift Voucher is valid for three years from the date purchased. A Gift Voucher is non-refundable. A Gift Voucher is transferable. You will receive a Gift Voucher confirmation with a Voucher Code. This code is only active once full payment is received. **Please note that a purchased Gift Voucher is not an active booking in our system. Special note for third party bookings: If a Gift Voucher is booked by an Agent/establishment on behalf of their client, a payment link will be forwarded to the Agent/establishment. This link should be sent to the client for payment, to activate the voucher code. The client can use the voucher code to make an online booking via the Wine Valley Adventures website. The commission will be paid once we receive full payment. The vehicle transfer fee is non-refundable. CONDUCT * The Client agrees that he/she will at all times comply with the Company’s or others’ requirements and instructions in regard to his/her conduct and he/she will not in any way constitute a hindrance to any other passenger or person on the tour, mode of conveyance, at any place of accommodation, The Client indemnifies and holds harmless the Company against damages suffered and/or costs incurred by the Company and/or any third party as a result of a breach of this clause. SPECIAL REQUESTS * Client, who has special requests, must specify such requests to the Company in writing. Whilst the Company will use its best endeavors to accommodate such requests, it does not guarantee that it will. AMENDMENTS * No amendment, cancellation or waiver of any term or right referred to herein shall be valid or binding unless reduced to writing and signed by both the Client and a duly authorized representative of the Company. The required indemnity form can be signed online from your mobile phone to ensure that you have sufficient time to read and understand the conditions. We are asking for more detailed information than usual. This information is to ensure we can address appropriately any risks, should you or one of our guests or staff become ill with suspected COVID-19, and to ensure that in such an event, the required contact tracing can be carried out. WAIVER AND INDEMNITY * While every precaution is taken to ensure the safety of all persons participating in the activity the client, his/her heirs, dependants, agents, executors or their assignees hereby irrevocably waive any claims which they may have against the Company for any form of compensation for damages which they may suffer due to injury and / or loss of any nature whatsoever, which includes accidents caused by the client's own actions, injuries or death while on the adventure experience, in transportation vehicles or at any place during the equipment, itinerary changes, nor for any arbitrary measures taken by local authorities, nor for any other circumstances or Acts of God which lie without the realm of our responsibilities. The Company shall not be liable for any reservations made by client directly with any establishment/operator/service/transportation and/or its proper/timeous execution. HEALTH * It is the client's obligation to ensure that he / she is medically fit and able to embark upon the activity. The Company opinion on health issues is not final and must be reconfirmed and verified by/with a medical practitioner authorised to advice on health issues/questions. The Company cannot be held liable if client (s) follow unprofessional advices on any health issues/questions. BAGGAGE * All baggage and personal effects are at all times at the client's risk and The Company cannot accept any liability for any loss or damage of baggage or any personal effects. INSURANCE * This is for the client’s own account and should be in place should the client require same. TO BRING * Sunscreen, comfortable closed shoes, warm clothing. A STARRING ROLE - PHOTOGRAPHIC MATERIAL * We take photographs, films and videos (including in electronic format) of our guests during the excursion, and may use such photographic, film and video material for the purpose of any advertising or brochure productions, which the client irrevocably gives his consent thereto, and without any consideration being payable to the client. GENERAL * Upon the confirmation of any booking, it shall be regarded that the client has read and accepted all the terms and conditions contained herein. DISPUTE – RESOLUTION * Firstly the parties will meet within 5 (five) working days of the dispute arising in an attempt to resolve the matter amicably. CANCELLATION POLICY 3.1 PRIVATE CHARTERS ( Exclusive Use ) 1.The Cancellation Fee will be 100% of the Private Charter Rate should the client cancel the charter within 48 hours ( 2 Days ) of the departure time . 2. The Cancellation Fee will be 50% of the Private Charter Rate should the client cancel the Charter within 30 days of the departure time. 3 .In the Case of Special Charters over Christmas Day, New Years Day, New Years Eve, Easter Weekend and Ocean Race Events, the Cancellation Fee will be 100% of the Private Charter Rate. 4. If a Private Charter is cancelled by us because the skipper deems it unsafe for the charter to take place, a full refund will be made on the Private Charter Rate; however any extras will be the client’s responsibility. (eg: catering and any other special arrangements made by the charterer or on behalf of the client). 5. Waterfront Adventures (Pty) Ltd will try to arrange an alternative as best it can, should the charter be cancelled for whatever reason by us and will not be held liable for any losses incurred by the person or company chartering the vessel. Any additional Extra costs in Chartering an alternative vessel will be for the clients account. 1.The Client will be liable for a 100% cancellation fee if the client does not arrive for a Booked cruise and does not inform the office .We Term a none arrival for a booked cruise as a "No Show " 2.There will be no cancellation Fee if the client calls the office 2 hours before the departure time and moves the booking to another day . 3. In The Case of Special Scheduled Cruises over Christmas Day , New Years Day , New Years Eve and Easter Weekend the Cancellation Fee will be 100% of the Scheduled Cruise Ticket Price . 1. All catering is to be finalised at least 5 days prior to the event and this includes payment for any catering. 2. 1.All bar tabs are to be settled before disembarking the vessel at the end of the Charter (unless prior arrangements have been made). 2.2. All bar tabs that are settled after the event are subject to a 10 % gratuity. 3. No beverages are allowed to be brought aboard the vessel without prior arrangements. 4. If the charter is cancelled due to bad weather or any other reason, the client will be responsible for any catering arrangements made ( See Cancellation policy Above ) ________________________________________ 5. GENERAL 1. Waterfront Adventures (Pty) Ltd cannot be held liable for any damage to or loss of personal goods. 2. All passengers, once aboard the vessel, fall under the direct authority of the Skipper and vessel owners and undertake to comply with any requests and/or instructions issued to them by such persons. 4. Passengers undertake, at all times, to respect the environment and will not intentionally pollute, damage or otherwise harm sea life and the surrounding environment. 5. Should any damages be incurred to any and all property or equipment of the Waterfront Adventures, due to negligence or misconduct by Charterer , their guests, employees or promoters, the Charterer will be held fuly liable for replacement of such property or equipment 6. FORCE MAJEURE 1. The Operator will be free from liability for failing to provide a service due to industrial action, unsuitable weather conditions, technical problems or other events beyond the Operator's reasonable control. Charters will go ahead regardless of weather conditions. Payment may be made via Visa, MasterCard, credit cards for online bookings. Bank transfers or cash will only be accepted for direct bookings into the Waterfront Adventures (Pty) Ltd bank account, the details of which will be provided on request Credit card acquiring and security Credit card transactions will be acquired for Waterfront Adventures (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gatewa. A national and international team of researchers are currently unravelling the fascinating and unique history of fossils from the West Coast Fossil Park and attempting to recreate the environment and climate of the West Coast some 5 million years ago. At this time many animals that are now extinct, such as sabre-toothed cats, short-necked giraffes, hunting hyenas and African bears roamed the west coast which then had a more subtropical climate with lush, riverine forests and open grasslands. A new Visitor Centre has been constructed using funds from the National Lotteries Commission (NLC) and now hosts a brand-new exhibition hall, restaurant, shop, amphitheatre, conference, meeting and office facilities in addition to the open dig site that many past visitors are familiar with. Dig site The West Coast Fossil Park preserves fossil evidence from approximately 5 million years ago. In 1998 a team of professional archaeologists and palaeontologists began excavating the current dig site that is open to the public. The site was chosen based on the fossils that were collected in this area by Dr Brett Hendey in 1975 and 1976 whilst the phosphate mine was in full operation. Dr Roger Smith heads up the current “public” excavation site which is dominated by numerous sivathere remains. The particular species of sivathere found here is named after Brett Hendey, Sivatherium hendeyi. Fully mature adults are estimated to have weighed up to 2000kg. A number of the fossils were removed and are now housed at the Iziko National Museum in Cape Town. However, some of the excavations have been preserved in situ (in their original place) so that members of the public can learn about this site and the amazing animals that have been discovered here. WEST COAST NATIONAL PARK Natural & Cultural History The key conservation areas of West Coast National Park are the Langebaan Lagoon and the offshore islands in Saldanha Bay, which together form the Langebaan Ramsar site, a wetland of international importance. The lagoon has a rich diversity of marine invertebrates and seaweeds and supports approximately 10% of the coastal wader population in South Africa. The offshore islands provide important nesting areas for several red-listed seabird species. The Langebaan Lagoon was proclaimed as a marine reserve in terms of the Sea Fisheries Act in 1973 and later in 1985, was proclaimed Langebaan National Park with the name later being changed to West Coast National Park. It was on 25 April 1988 that the Langebaan Ramsar site was declared. The initial purpose of the park area was to protect the key conservation areas of the Langebaan Lagoon and associated wetlands as well as the offshore islands in Saldanha Bay. The management focus has since broadened to include the terrestrial surroundings as representative sites of the ecosystem of the West Coast Region. In 1987, the first expansion of the park occurred, including a dune reclamation scheme, Geelbek and portions of the farms Bottelery, Schrywershoek and Abrahamskraal. In the same year, some 1,800 ha of land around Postberg was included on a contractual basis and a hotel site in Langebaan was also included in the park. Today the park, including the lagoon, islands, contractual areas and MPAs, covers some 40 000ha. About the West Coast National Park In the South African Context, the salt marshes of Langebaan are unique in that no river feeds into the lagoon. These salt marshes constitute approximately 32% of the entire salt marsh habitat in the country, the largest in South Africa. The lagoon is entirely marine with relatively stable salinity and supports dense populations of molluscs and crustaceans as well as 71 species of different marine algae. The lagoon also serves as a nursery for the development of juvenile fish; the extensive intertidal areas of the lagoon support up to 55,000 water birds in summer, most of which are waders (23 species), including 15 regular Palaearctic migrants. The five islands of Saldanha Bay to the north of the Lagoon provide a home for nearly a quarter of a million sea birds, many of which are endemic to the nearshore regions of South Africa and Namibia. Cape Gannets (Monis capensis) and Cape cormorants (Phalocrocorax capensis) are abundant and the largest known colony of Kelp Gulls (Larus doninicanus) in Southern Africa is found on Schaapen Island. WCNP mostly contains strandveld vegetation; with the expansion of the park it also included the Hopefield sand plain fynbos. Both these habitat units are given a 50% irreplaceability rating, however, sand plain fynbos is regarded to be of higher conservation value than strandveld, due to very little being formally conserved and it being more threatened by alien plant invasion. ARRIVAL AT VENUE Kindly ensure you arrive at the venue 30 minutes before your tour/activity departure time. Should you arrive later, your tour/activity may be forfeited and not refunded or rescheduled. If, however you contact us before your tour commencement time, we may be able to make alternate arrangements. Timeously means well beforehand. INDEMNITY All clients will be required to sign an indemnity before ANY tour/activity takes place. If a guest refuses to sign the indemnity form, the guest will not be able to partake in the tour/activity. The indemnity form must be signed by a Parent/Legal guardian for minors under 18 years. Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal guardian prior to the tour/activity. CHILD POLICY: Children Rates apply to minors aged between 4 and 11 years IN SOME OF THE TOURS/ACTIVITIES. Children are classified as a passenger, therefore, on certain tours/activities, the full rate will apply to them. Adult supervision is required for children of 14 years old and younger. Some tours/activities do not allow children under 18 years old. Booking and Payment ● Full Payment: Full payment must be received when booking for your activity prior to the tour/activity date. ● Payment Methods: We accept payments via all major credit/debit cards, bank transfer, Ecocash. ● Booking Confirmation: Your booking will be confirmed upon receipt of full payment and issuance of a confirmation email/voucher. 2. Cancellations and Refunds ● Cancellations by Customer: o A 100 % cancellation fee will be charged if the booking is cancelled 7 days prior to the activity. A 80 % cancellation fee will be charged if the booking is cancelled 14 days prior to the activity. o A 50 % cancellation fee will be charged if the booking is cancelled 30 days prior to the activity. o All No-Shows will be 100% cancellation fee charged o o EXCEPTIONS TO THE CANCELLATION POLICY Medical certificate Delays in travel due to technicalities beyond control Bereavements Any other exceptions will be authorised by the Sales Manager ● Cancellations by Company: ○ We reserve the right to cancel a tour/activity due to unforeseen circumstances (weather, insufficient bookings, etc.). If we cancel, you will be offered a full refund or the option to reschedule. 3. Changes and Modifications ● Itinerary Changes by Company: We reserve the right to make changes to the tour/activity itinerary due to unforeseen circumstances. We will endeavour to provide alternative arrangements of similar value. ● Changes Requested by Customer: We will try to accommodate reasonable changes requested by you, subject to availability and any additional costs. 4. Insurance ● Travel Insurance: We strongly recommend that you obtain comprehensive travel insurance that includes cancellation coverage, medical expenses, personal belongings, and emergency evacuation. 5. Liability ● Assumption of Risk: You acknowledge that participating in tours/activities may involve inherent risks. You assume full responsibility for any risks, injuries, or damages that may occur. ● Waiver of Liability: You agree to release and hold harmless Abseil Victoria Falls, its employees, and agents from any liability, claims, or damages arising from your participation in the tour/activity. ● Company's Liability: Our liability is limited to the total price paid for the tour/activity. We shall not be held liable for indirect, incidental, or consequential damages. 6. Health & Safety ● Physical Fitness: You acknowledge that our tours/activities may require a certain level of physical fitness. It is your responsibility to ensure you are fit enough to participate. ● Medical Conditions: Please inform us of any pre-existing medical conditions that may affect your participation. ● Compliance with Instructions: You agree to follow the instructions of our guides and staff at all times for your safety and the safety of others. 7. Photography & Filming ● Promotional Use: You grant us permission to use any photographs or videos taken during the tour/activity for promotional purposes, unless you express otherwise in writing. 8. Rates o RATES All rates quoted are in UNITED STATES DOLLARS o RATES INCLUDE Return road transfers from all Lodges and Hotels within Victoria Falls town (Zimbabwe) excludes Lodges inside National Parks and beyond Truck Stop. o RATES EXCLUDE Rainforest Park Entrance Fees Photos and Videos purchased online Park entry fees that may be levied 9. Acceptance of Terms ● By booking a tour/activity with us, you signify your agreement to and acceptance of these Terms and Conditions.
