ARRIVAL AT VENUE Kindly ensure you arrive at the venue 30 minutes before your tour/activity departure time. Should you arrive later, your tour/activity may be forfeited and not refunded or rescheduled. Any unaccompanied child 18 or under requires the indemnity to be signed by a parent/legal guardian prior to the tour/activity. Children are classified as a passenger, therefore, on certain tours/activities, the full rate will apply to them. Adult supervision is required for children of 14 years old and younger. Complementing this, the Whale Whisperer, a 4m semi-rigid inflatable, accommodates 24 passengers and 4 crew members. Our vessels offer ample space, furnished with dedicated platforms for photographers, onboard toilette facilities, and a PA system. While we retain the prerogative to deploy any of our vessels based on passenger count, rest assured that your comfort and safety remain our priority. Dyer Island, located 8 km offshore, stands as an access-controlled Important Bird Area (IBA), safeguarding numerous resident avian species, including the endangered African penguin. Situated adjacent to Dyer Island is Geyser Rock, which is home to a robust colony of 60,000 Cape fur seals, present year-round. Our journey will take us through the world-famous channel known as ‘Shark Alley’, nestled between Dyer Island and Geyser Rock, Gansbaai includes various species of seabirds such as albatrosses, petrels, shearwaters, gannets, and terns, these birds are adapted to life at sea and can be seen gliding over the waves, diving for fish, or resting on the water’s surface. The Southern right whale season extends from June to November, during which our focus shifts to observing these magnificent creatures as they visit our coastal waters for mating and calving purposes. Throughout the year, we may also encounter the more reserved resident Bryde’s whale. The period spanning December to June offers opportunities to actively search for this species during our tours. Additionally, we may encounter the majestic Humpback whales during the initiation and conclusion of their migration cycle. Our region also boasts three distinct dolphin species—common, bottlenose, and the endangered humpback variety. As luck would have it, we may have the privilege of encountering one of these species. This marine adventure includes a visit to the shark cage diving vessels in the area to offer a sighting of a bronze whaler shark or the awe-inspiring great white shark. Our boats are situated at 1 Jetty Street in Colchester, less than 30 30-minute drive from Port Elizabeth, just below the Southern entrance gate of Addo National Elephant Park. The usage of either of our boats will be dependent on the amount of people attending the cruise. We cater for groups of 1-42 people. A 50% deposit should be received within 7 days of receipt of the Private Charter Invoice. 3.Full payment should be received at least 7 days prior to the event 4.Private Charters must be booked for a minimum of 2 hours over the Sunset period .(between 17h00 and 21h00 depending on time of year) 5.Full payment is required before a Ticket or Boarding pass is issued . A Boarding pass is required for access to the vessel. 6. Payment not made within the agreed arrangement will be raised at 5% plus prime. 1.Enquiries by email or telephone are entered onto our booking Tracker System and an email is generated 2.Clients may follow the link and pay online by credit card 3.Enquiries and provisional bookings are only confirmed when they have been paid . CANCELLATION POLICY 3.1 PRIVATE CHARTERS ( Exclusive Use ) 1.The Cancellation Fee will be 100% of the Private Charter Rate should the client cancel the charter within 48 hours ( 2 Days ) of the departure time . 2. The Cancellation Fee will be 50% of the Private Charter Rate should the client cancel the Charter within 30 days of the departure time. 3 .In the Case of Special Charters over Christmas Day, New Years Day, New Years Eve, Easter Weekend and Ocean Race Events, the Cancellation Fee will be 100% of the Private Charter Rate. 4. If a Private Charter is cancelled by us because the skipper deems it unsafe for the charter to take place, a full refund will be made on the Private Charter Rate; however any extras will be the client’s responsibility. (eg: catering and any other special arrangements made by the charterer or on behalf of the client). 5. Waterfront Adventures (Pty) Ltd will try to arrange an alternative as best it can, should the charter be cancelled for whatever reason by us and will not be held liable for any losses incurred by the person or company chartering the vessel. Any additional Extra costs in Chartering an alternative vessel will be for the clients account. 1.The Client will be liable for a 100% cancellation fee if the client does not arrive for a Booked cruise and does not inform the office .We Term a none arrival for a booked cruise as a "No Show " 2.There will be no cancellation Fee if the client calls the office 2 hours before the departure time and moves the booking to another day . 3. In The Case of Special Scheduled Cruises over Christmas Day , New Years Day , New Years Eve and Easter Weekend the Cancellation Fee will be 100% of the Scheduled Cruise Ticket Price . 1. All catering is to be finalised at least 5 days prior to the event and this includes payment for any catering. 2. 1.All bar tabs are to be settled before disembarking the vessel at the end of the Charter (unless prior arrangements have been made). 2.2. All bar tabs that are settled after the event are subject to a 10 % gratuity. 3. No beverages are allowed to be brought aboard the vessel without prior arrangements. 4. Travellers/delegates shall be solely responsible for complying with the formalities required by police, customs, health and all other authorities at the point of departure, at the destination and whilst in transit. Should this be ignored, the traveller/delegate will be sent back to their country of origin upon arrival at ORTIA, without permission to enter the country. It is strongly recommended that all clients take out comprehensive travel insurance including full medical cover, as well as cancellation and curtailment cover. Luggage must be clearly marked. One standard set of luggage, comprising one suitcase and one overnight bag per person is allowed. If in the opinion of Roof of Africa Tours (Pty) Ltd. the fulfilment of any tour, incentive or conference, or accommodation is considered impossible, illegal, or if in Roof of Africa Tours (Pty) Ltd. opinion inadvisable because of weather conditions, avalanches, volcanic activity, strikes, war, government interference and/or any other cause not arising from Roof of Africa Tours (Pty) Ltd. negligence, Roof of Africa Tours (Pty) Ltd. may at any time cancel such a tour, incentive or conference, or accommodation, or what remains of it or make alterations in the route, accommodation, price and/or any other aspect thereof as it thinks fit, and any losses and expenses resulting from such cancellation or alteration shall be borne by the client. In accordance with South African law and International practice, smoking is prohibited on vehicles at all times. The tourist guide or the driver will ensure that sufficient comfort stops are made to enable travellers to smoke outside. Accommodation is as specified in the tour itinerary, brochure or website. The use of specific accommodation is subject to availability. Any inconveniences caused to the traveller or delegate must be compensated for by the accommodation establishment in error. Prices are subject to change without prior notice. Quotations are valid only to the expiry date stated on the quotation and are subject to adjustment if the services quoted for are not available at the time of booking. Quotations are based on itineraries and requirements specified by the customer. Upon acceptance of the quotation, any changes requested by the customer which incur additional costs will be charged to the customer. Payment shall be made in all instances (by account holders and non-account holders) in the currency in which the quotation was accepted or in which the invoice is made out. All payments shall be made to Roof of Africa Tours (Pty) Ltd. free of deductions or set off of any nature whatsoever, at such place and in such manner as Roof of Africa Tours (Pty) Ltd. may authorize from time to time in writing. Bank charges are the responsibility of the transferor. Should any amount not be paid on due date, then the client shall be liable to pay Roof of Africa Tours (Pty) Ltd. interest on all such amounts calculated from the due date until payment at the prime bank overdraft rate. Payment in approved foreign currency will be accepted at the rate of exchange applied by the bankers of Roof of Africa Tours (Pty) Ltd. at the time of receipt of payment. Any shortfall resulting from exchange rate fluctuations will be for the account of the passenger. If the client makes a booking on behalf of any party, the client warrants to Roof of Africa Tours (Pty) Ltd. that the client is authorized by such traveller/delegate to make reservations on behalf of such traveller/delegate and is acting as such traveller’s/delegate’s agent and in so doing, binds such party to these conditions. Upon the reservation being accepted and confirmed by Roof of Africa Tours (Pty) Ltd., the client warrants that the traveller/delegate has been informed of and is bound by the terms and conditions set out herein. The client indemnifies and holds Roof of Africa Tours (Pty) Ltd. harmless against all claims for damage, loss and injury which any traveller/delegate may claim against Roof of Africa Tours (Pty) Ltd. if such claim is excluded in terms hereof. Provisional reservations held by Roof of Africa Tours (Pty) Ltd. on behalf of the client/traveller or delegate will be released if no confirmation in writing has been received by the client/traveller/delegate by the “confirm by date”, or if no deposit has been received. When requested by Roof of Africa Tours (Pty) Ltd., the client/traveller/delegate shall pay a deposit to Roof of Africa Tours (Pty) Ltd. to secure certain services. The standard deposit requirements as a percentage of the total booking value are as follows: * 13 months and over prior to travel 0% * 12 months prior to travel 15% * 3 months prior to travel 50% * 1 month prior to travel 100% Roof of Africa Tours (Pty) Ltd. reserves the right to change the standard deposit requirements, to be recorded in writing, on a separate contract between the client and Roof of Africa Tours (Pty) Ltd. and to be agreed upon and signed by both parties. The percentage deposit required of the total booking value will be determined according to the specific services required and the number of years, months or days prior to travel. All cancellations must be made in writing to Roof of Africa Tours (Pty) Ltd.. Roof of Africa Tours (Pty) Ltd. will reply back in writing to the client/traveller/delegate that the reservation has been cancelled. Should a reservation be cancelled by the client, traveller or delegate, cancellations fees will be due and payable as a percentage of the total booking value.
